Abstract

The Special Courts are required to ensure that children are not repeatedly called to testify and are allowed frequent breaks during the trial. Protection of the child's identity is crucial, and the document highlights instances where the identity of the victim was compromised. It also emphasizes the empowerment of Special Courts to direct payment of compensation for physical or mental trauma caused to the child. The prompt recording of evidence and disposal of cases within a year are emphasized, along with the requirement to avoid exposing the child to the accused while testifying. Additionally, the document discusses a specific case related to the interpretation of the POCSO Act, highlighting the Supreme Court's clarification and widening of the interpretation of Section 7, emphasizing that the intention of the offender to touch a child inappropriately is enough to attract the provisions of this section.
